Terms of Service

GARAN Label & EU Warranty · Last updated: October 2026

This English version is provided for information only. The German version (AGB) is legally binding.

1. Scope and conclusion of contract

1.1 These Terms of Service ("Terms") govern the use of the Shopify app "GARAN Label & EU Warranty" (German listing name "Gewährleistungslabel & GARAN", the "App"), provided by Maik Gossen, sole proprietor, Im Siekertal 6, 32545 Bad Oeynhausen, Germany ("Provider", "we" or "us").

1.2 By installing the App in your Shopify store you agree to these Terms. If you do not accept them, you may not install or use the App.

1.3 These Terms supplement Shopify's terms of service. In case of conflict, Shopify's terms prevail insofar as they concern the Shopify platform.

1.4 The App is intended exclusively for businesses operating a Shopify store ("Merchant" or "you").

2. Description of services

2.1 The App provides technical tools that allow Merchants to display the harmonised notice on the legal guarantee under Annex I of Implementing Regulation (EU) 2025/1960 and the harmonised label (GARAN label) under Annex II in their store, using the files provided by the European Commission.

2.2 The Free plan includes: display of the notice on product pages and in the cart via a theme app embed and an optional app block, automatic language selection across 24 official EU languages, a clickable link to the Your Europe portal, a GARAN label per product, a snippet for the order confirmation email, and automatic exclusions (e.g. gift cards, products without shipping, B2B) for unlimited products. The Free plan shows a small line "EU guarantee notice by Shopify Freelancer Maik Gossen".

2.3 The Pro plan additionally offers: removal of that line, bulk editing of GARAN data by vendor, tag or product type, CSV import and export, box design (colours, width, corner radius, alignment), custom link text per language, display to EU/EEA visitors only, change log export as CSV and priority support.

2.4 We may develop, extend or adapt the App's features. We will announce material restrictions of existing features at least 30 days in advance.

3. Technical tool, no legal advice

Important: The App is a technical tool. Neither the App nor the content of this website constitutes legal advice. We are not a law firm and do not provide legal services.

3.1 The App makes it easier to display the EU mandatory information. It does not replace individual legal advice and does not guarantee legal compliance in any specific case.

3.2 The Merchant remains solely responsible for complying with all statutory information duties, in particular whether, where and how the notice and GARAN label must be shown in the store, at checkout and in emails.

3.3 Whether a product requires or may carry a GARAN label is decided solely by the Merchant based on the producer's information. The Merchant is responsible for the accuracy of the data entered (guarantee duration, brand, model identifier).

3.4 We recommend having your implementation reviewed by a lawyer.

4. Requirements

4.1 Use requires an active Shopify store with a valid Shopify subscription and a theme that supports theme app extensions.

4.2 If you install the App on behalf of a company, you confirm that you are authorised to represent it.

4.3 You are responsible for the security of your Shopify credentials and for all activity in your account related to the App.

5. Plans, prices and payment

5.1 The App offers a Free plan that is free forever and a paid Pro plan (currently USD 4.99 per month with a 7-day free trial). The prices shown in the Shopify App Store and in the App apply.

5.2 Billing is handled exclusively via Shopify Billing. Payments, invoices and refunds are processed by Shopify under Shopify's payment terms.

5.3 We will announce price changes at least 30 days in advance. Shopify may ask for your renewed approval of a price change.

5.4 You can downgrade to the Free plan or cancel at any time in the App or by uninstalling it. Refunds follow Shopify Billing's policies.

6. Licence and intellectual property

6.1 For the duration of use we grant you a limited, non-exclusive, non-transferable and revocable licence to use the App in accordance with these Terms.

6.2 All rights in the App (software, design, texts, graphics, logos) remain with the Provider. The official EU graphics (notice and GARAN label) are templates of the European Union and are used unchanged; the App is not affiliated with the European Commission.

6.3 Data entered by the Merchant, in particular the GARAN metafields in their store, remains the Merchant's.

7. Acceptable use

7.1 When using the App you must not:

7.2 Violations may lead to suspension of access, without prejudice to further claims.

8. Merchant responsibilities

8.1 The Merchant is responsible in particular for:

8.2 The Provider is not liable for damage resulting from a breach of these duties.

9. Availability and support

9.1 We aim for high availability but do not guarantee any specific uptime. Interruptions may occur in particular due to maintenance, updates or outages at Shopify or the hosting provider.

9.2 Support is available by email at info@dd-gossen.com. Pro users are prioritised. No specific response times are guaranteed.

10. Warranty

10.1 We do not warrant that the App is compatible with every Shopify theme or third-party app, or that using it alone ensures full compliance with all information duties.

10.2 Otherwise, statutory law applies.

11. Liability

11.1 We are liable without limitation for injury to life, body or health, for intent and gross negligence, and under the German Product Liability Act.

11.2 In cases of slight negligence we are only liable for breach of an essential contractual obligation (cardinal obligation), limited to the foreseeable damage typical for this type of contract.

11.3 Otherwise liability is excluded, in particular for fines, costs of cease-and-desist letters, damage resulting from incorrect Merchant data, outages of third-party services (Shopify, hosting), indirect damage and lost profits, unless section 11.1 applies.

11.4 Where liability is not unlimited under section 11.1, it is capped at the fees paid by the Merchant in the preceding 12 months, but at least EUR 100.

11.5 These limitations also apply in favour of our vicarious agents.

12. Term and termination

12.1 The contract starts when the App is installed and runs for an indefinite period.

12.2 You can terminate at any time by uninstalling the App. A running Pro subscription ends according to Shopify Billing's rules.

12.3 We may terminate with 30 days' notice. The right to terminate without notice for good cause, e.g. for serious breaches of section 7, remains unaffected.

12.4 After uninstalling, all data stored for your shop is deleted once Shopify sends the shop/redact privacy webhook (usually 48 hours after uninstall). Pro users can export GARAN data via CSV beforehand.

13. Force majeure

Neither party is liable for delays or failures caused by force majeure, such as natural disasters, pandemics, industrial action, official orders, cyber attacks or outages of essential third-party services.

14. Changes to these Terms

14.1 We may change these Terms with at least 30 days' notice. We will announce material changes by email or in the App.

14.2 If you do not object within that period and continue to use the App, the changes are deemed accepted; we will point this out in the notice. If you object, you can uninstall the App.

15. Data protection

15.1 Details on data processing are set out in the Privacy Policy.

15.2 The App does not store personal data of the Merchant's end customers and does not process such data on the Merchant's behalf. A data processing agreement (DPA) under Art. 28 GDPR is therefore not required and does not form part of these Terms.

16. Governing law and jurisdiction

16.1 The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.

16.2 The exclusive place of jurisdiction is Bad Oeynhausen, Germany, where the Merchant is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany.

17. Final provisions

17.1 If individual provisions are invalid, the validity of the remaining provisions is not affected; statutory law then applies.

17.2 Please send notices to info@dd-gossen.com. Notices to you are sent to the email address in your Shopify account.

17.3 The German version of these Terms is binding.
